The following is a statement of FSP’s licensing experience. The matters are described in general terms to protect confidentiality. The list is not intended to be exhaustive, but illustrative. Liquor and entertainment licensing - Licensing Act 2003
 

Premises
licences

Advising, guiding and representing businesses and clubs, from corner-shops via golf-clubs, restaurants, pubs and night-clubs to major sports stadiums throughout the process of applications for new premises licences.
 

 

Liaison with the local authorities, police and fire service in order to ensure the smoothest possible transition process. Negotiating with objectors with a view to avoiding the need for hearings.
 

Dealing with straight conversions of Justices’ Licences and/or Public Entertainment Licences, conversion and variation applications (adding hours and/or new licensable activities) and with applications for entirely new licences.
 

Personal
licences

Advising clients on simple "grandfather" applications, entirely new personal licences and dealing with police objections on the crime prevention ground (for clients with serious criminal convictions).
 

Contested hearings

Conducting contested hearings in the Magistrates’ Court in relation to opposed applications for Justices’ Licenses and Club Registration Certificates and appeals against refusals or conditions imposed on Public Entertainment Licences.
 

Offences

Representing clients in the Magistrates’ Courts charged with offences such as sale of alcohol to a minor or breaches of Public Entertainment Licence Conditions. Advocacy, including trial advocacy, conducted personally leading to not guilty verdicts and/or dealing with guilty pleas and mitigation.

 


Betting and gaming
 

Bookmakers

Advising bookmakers in relation to obtaining new Bookmakers’ Permits and Betting Shop Licences.
 

 

Dealing with objections and Crown Court appeals regarding applications for new Betting Office licences.
 

Casinos

Advising a client in relation to issues about the grant of a new casino licence.
 

Lotteries

Advising clients and applying to Local Authorities for Society lottery licences.

 


Sex premises
 

Grants/renewals

Representing clients in Council Licensing Committee meetings for grants/renewals of Sex Establishment Licences, dealing with substantial local objections from the Public and local Councillors.
 

Appeals

Representing a client in Judicial Review proceedings following refusal of renewal of a Sex Establishment Licence leading to rescission of the original decision and return of the original renewal application to Committee for re-consideration.

 


Taxis and private hire vehicles
 

Licensing committee

Conducting hearings before Council Licensing Committee meetings in relation to renewals of Hackney Carriage and Private Hire Vehicle drivers licence and Private Hire Vehicle Operators licences. Addressing objections by the public, the Police and the Council Licensing Department.
 

Appeals

Conducting appeal hearings in the Magistrates’ Court in relation to decisions made by the Council Licensing Committee.
 

Offences

Representing clients in the Magistrates’ Courts charged with offences such as Plying for Hire or Operating unlicensed Drivers. All advocacy conducted personally, including trial advocacy leading to not guilty verdicts and/or dealing with guilty pleas and mitigation.
