The following is a statement of FSP’s family and matrimonial experience. The matters are described in general terms to protect confidentiality. Divorce

Advising a client, born in the United Kingdom but living permanently in France, whose estranged wife was based in the UK, upon the most appropriate jurisdiction to bring divorce proceedings, whether in France or the UK. Involving detailed consideration of law in relation to matrimonial finance in both countries and liaising closely with Parisian lawyers.
 

Judicial Separation

Advising a female client in relation to judicial separation proceedings and financial matters associated therewith, when the marriage lasted no longer than the honeymoon period.
 

Nullity

Advising a client on whether to bring divorce or nullity proceedings against his Turkish wife, involving immigration issues, upon the non-consummation of their marriage.
 

Matrimonial Finance

Acting for a male client, owner of a large property portfolio, in relation to claims brought by his estranged wife, after only 4 months of marriage, to a substantial lump sum payment, exceeding £200,000, by virtue of her “contribution” to the property business. Case proceeded to appeal where the husband was ultimately successful.
 

Advising a female client whose estranged husband was claiming a substantial share of her personal injury damages awarded to compensate her for serious injuries suffered as a result of an accident.
 

Acting for a male client whose third wife successfully applied to the Court without notice to the husband to freeze all of the husband’s bank accounts to prevent the husband dissipating capital assets.
 

Advising husband in contested financial proceedings in relation to the value of his multi-million pound company over which wife was laying claim. This involved consideration being given to the involvement of forensic accountants for each party, together with the consideration and interpretation of their findings.

Advising husbands and wives regarding content and validity thereof.

 
Deeds of Cohabitation

Advising those considering cohabiting, regarding the protection afforded to them in the event of separation, by virtue of a deed of cohabitation
 

Domestic Violence

Advising male client, respondent to an application for a domestic violence injunction, following an incident in which a third party had been killed. This included setting out in full the client’s version of events and seeking contact with the client’s children whilst in prison.
 

Finance on Death

Acting for male client following death of his partner of 20 years in relation to a claim over her estate when inadequate provision was made for him in his partner’s will. The case involved fully contested proceedings involving the partner’s children who sought to oust the male client from the home that he had shared with his partner prior to death on the basis that he was not a partner but a lodger.
 

 

Advising client after the premature death of her fiancé in relation to a claim brought by her fiancé's father to an interest in a property held in the client’s sole name by virtue of the fiancé's contribution thereto.
 


Children Act Proceedings
 

Private Law

Acting for grandparents upon application for contact and residence of grandchildren, in cases involving intractable hostility of one or other of the parents.
 

 

Acting for wife on application to remove children from jurisdiction in order to live in a foreign country. Application opposed by father of children and case proceeded to fully contested hearing at which wife was successful.
 

 

Acting for university student claiming financial relief from father following termination of child maintenance order, in order to support her through university.
 

Public Law

Acting for same sex couple in adoption proceedings and upon application for joint residence order of child placed with them by local authority.
 

 

Acting for children’s guardian in care proceedings brought by local authority following non-accidental injury to child whilst in her parents’ care. To include detailed analysis of cause of child’s injuries when parents first of all blamed third parties and then blamed each other.
